Terms and Conditions for "Got Ya Back" T-Shirt Fundraising Platform

 

 

By using the Got Ya Back web site you agree to be bound by these Terms & Conditions.

All use of the products and services offered on the Got Ya Back web site and any information or other content on the Got Ya Back web site is governed by these Terms & Conditions.

This web site is owned and operated by Selector Uniforms Limited under the domain name www.gotyaback.co.nz. The principal place of business for Selector Uniforms is 216 Dee St, Invercargill, New Zealand. We can be contacted on 0800 788 878 and/or office@selectoruniforms.co.nz.

All prices are in New Zealand Dollars.

1. Fundraising Campaigns:

  • Teams must set the campaign deadline at least 3 weeks before the required t-shirt date.

  • Teams can participate in campaigns as often as they like.

 

2. Payment Process:

  • Donors purchase spaces online using credit or debit cards through the provided online payment portal.

 

3. Unmet Fundraising Goals:

  • Teams failing to meet their fundraising goal must cover the t-shirt cost, deducted from the funds raised before returning the profit. Should the funds raised not meet the t-shirt cost the team will be responsible for covering the remaining cost.

 

4. T-Shirt Distribution:

  • Our services are only available for New Zealand residence. Delivery can only be made to a New Zealand adress

  • T-shirts can be collected from our showroom at 216 Dee St Invercargill or delivered to a specified address.

  • Teams are responsible for covering any shipping costs. This will be deducted from funds raised

  • Orders will be delivered by Got Ya Back’s preferred courier, unless otherwise arranged at time of order. This will be charged at the rate ruling at the time based on the weight and volumetric size of the parcel/s.

  • Delivery is on or prior to the date required set by the campaign manager when establishing the fundraising campaign. A 2 day tracked courier service will be used for all deliveries. Alternatively orders will be collected from our showroom at 216 Dee St, Invercargill Monday – Friday 9am to 5pm

 

5. Design and Printing:

  • Teams select a design layout from provided options for the back.

  • Teams can include their club logo on the left chest, not exceeding 10cm wide.

  • Got Ya Back is not responsible for spelling errors caused by users.

 

6. Colour and Quantity:

  • Printing is in CMYK colors; PMS colors matched closely.

  • All goods are printed using industry accepted printing processes. However, we shall not be held liable for wear and tear. We will match PMS colours as accurately as our inks will allow. Half tones and detailed graphics may reproduce less than perfectly on some products and we will take no responsibility for such imperfections other than where we have made recommendations to the customer.

  • We acknowledge that product colours may not be displayed accurately due to factors such as screen resolution. If you require a very specific colour we suggest you get in touch with us to discuss.

  • Orders cannot be cancelled once the campaign begins.

  • Minimum order quantity is 10.

  • T-shirt colour is subject to availability; teams will be informed within 2 working days if the chosen colour is unavailable.

 

7. Online Platform Use:

  • Teams and donors agree to the use of the online platform under specified terms.

  • Donor information privacy is handled in accordance with the New Zealand Privacy Act 1993.

 

8. Legal and Dispute Resolution:

  • These terms are governed by the New Zealand Consumer Guarantees Act 1993 and the New Zealand Privacy Act 1993.

  • Disputes are to be resolved through a legal process in accordance with New Zealand laws

 

9. Returns

  • Printed items cannot be returned. Got Ya Back will not be responsible for the incorrect size garment ordered by customer.

  • Faulty merchandise should be reported directly to Got Ya Back for resolution within 10 days of receiving the goods

 

10. Guarantees

  • All products are guaranteed against manufacturing defects. Claims for defective goods will be settled by replacement and, credits or refunds will only be issued at our discretion.

 

11. Information

  • We take all reasonable steps to ensure your information held by us is held securely

  • We hold information provided by you as well as statistical information collected by the website

  • WE only release information about you when authorised by you, required by law or where required to process your order eg to a third party supplier or delivery company.

 

12. Cancellations

A Got Ya Back Fundraising Campaign cannot cancelled once setup. Once setup teams are liable for $95 including gst per t-shirt per participant. Got Ya Back Fundraising Platform does not offer refunds for donations. Should a group decide to not complete their campaign they will be liable for the cost of the t-shirts and be responsible for organising refunds to donors if required.

 

13. Donations

Got Ya Back Fundraising Platform does not offer refunds. Once donated the funds will be used to cover the cost of the T-shirt and the profits are returned to the campaign organiser. Should the club/school choose to cancel their campaign or their plans change Got Ya Back Fundraising Platform is not responsible for organising a refund this is the responsibility of the club/school should they see fit.

 

Due to the nature of websites, we cannot guarantee uninterrupted or continuous use of the site. At times, the website may be unavailable due to factors such as maintenance or unplanned outages. 

Unless otherwise stated, Got Ya Back is the owner of all copyright, trademarks and other intellectual property rights relating to the Got Ya Back website and its contents. This includes without limitation all intellectual property rights in respect of all text, graphics, logos, images and software that are included in the Got Ya Back web site.

Except as required for the use of the Got Ya Back web site or the Got Ya Back services in accordance with these Terms of Use, no material or information on the Got Ya Back web site may be reproduced, stored in an electronic or other retrieval system, altered, uploaded to a third party location, framed, performed in public or transmitted in any form by any process whatsoever without the express written consent of Got Ya Back.
